Changes to building regulations - October 2023

Completion certificates for Building Regulations applications submitted on or after 1st October 2023 can no longer be issued unless a notice of completion form has first been submitted.

This statement needs to be completed and signed by:

  • the client
  • principal contractor
  • principal designer (duty holders).

The clients signs to confirm that, to the best of their knowledge, the work complies with all applicable building regulations requirements.

The principal contractor and principal designer both sign to confirm that they fulfilled their duties under the building regulations.

These new requirements are set out under regulation 16(4) of the Building Regulations 2010 as amended by The Building Regulations etc. (Amendment) (England) Regulations 2023. They are to ensure that at each stage in building project duty holders are identified and roles, responsibilities and expectations are clear.

Duty holders are also required to ensure they:

  • have the necessary skills, knowledge and behaviour to carry out the design and building works
  • cooperate with other duty holders, coordinate their work, communicate and provide information
  • have arrangements and systems in place to plan, manage and monitor design and building work to ensure compliance with Building Regulations

The client must also take all reasonable steps to satisfy themselves that the duty holders are competent.
